Michael Jordan Tells Court He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle

Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, admitted that his competitive side and status as a newcomer emboldened his effort with 23XI Racing to “challenge” Nascar over perceived violations of competition laws.

Financial Stakes and a Will to Win

Jordan shared financial and corporate details of his 23XI team, saying he put in $40 million of his own funds into the Nascar Cup series team co-founded with partner Polk and driver Hamlin.

“Someone had to step forward,” Jordan stated during testimony. “As a newcomer, I had no fear. I believed I could take on Nascar in its entirety. I felt as far as the sport required examination through a new lens.”

Central Issue: Franchise System and Renewal Demands

At issue is the end of a 2016 agreement where Nascar provided each team a “charter”. The concept is similar to other professional sports with independent franchises, such as the NBA’s Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar demanded charter membership renewals.

Jordan was on the witness stand for about sixty minutes and left the court to pandemonium, with onlookers and reporters clamoring for a glimpse or a photo of the global icon.

Spearheading the Fight

Jordan’s 23XI is leading the full-court press along with another racing team for Nascar to overhaul a operating model Jordan contended is breaking the law to maintain excessive control.

At issue for Jordan and a fellow team representative, who testified before Jordan, are details from last September. Gibbs described a frantic and emotional period where the racing circuit told teams they must sign a contract extension. The document spanned 112 pages detailing pay for chartered teams and a guaranteed entry in every race.

A Refusal to Sign

Jordan explained that his team and its ally decided their sole viable path was to refuse a signature that 112-page package and litigate the matter. All other teams signed the agreement.

Jordan and co-owner Denny Hamlin reached out to Nascar about potential amendments or negotiations. Nascar wasn’t talking, Jordan said.

The Bottom Line: Victory

But in the end, the resistance against what he saw as a financially unsustainable model was driven by the usual bottom line for Jordan: Success.

“Denny convinced me getting a third driver boosted our odds of winning,” he testified, noting that he bought a third charter last year for $28 million amid the legal dispute. “So I dove in.”

Heather Gibbs detailed her push for indefinite franchises, which she said a formal letter to Nascar. She said the timing of the contract signing demand didn’t sit well.

According to her, Joe Gibbs first tried to call and talk Nascar out of forcing signatures, but CEO Jim France declined the request.

“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. The response was, “Whether I have 20 charters, that’s what I have. If I have 30, I have 30.”
